Anyone who wants to redesign a grave or add a memorial often asks themselves: Do I need a permit? The good news is: In many cemeteries, gravestones up to 30 cm high can be erected without special permission – often even without a foundation. Stricter regulations generally apply to upright gravestones, borders, or larger monuments. But what exactly does this look like? And what are the regional differences?

Approval – yes or no?
Whether a permit is required depends primarily on three factors:

Traditional gravestones – that is, flat, low-profile granite slabs – may be used in many locations without an application. They are often considered "exempt from permits" if they are not permanently fixed and their shape, size, and design blend in with the surroundings. However, we recommend consulting the respective cemetery administration beforehand.
Standing gravestones, borders, or specially designed monuments usually require a formal approval process. This often requires the submission of a drawing detailing the material, dimensions, engraving, and method of attachment.
Regional differences
In Germany, there are no uniform legal regulations governing the erection of gravestones. Instead, the cemetery regulations of individual cities, municipalities, or churches regulate the details – and these can sometimes differ significantly.
In some regions, a simple application with a few details is sufficient. In other cases, more comprehensive documents are required, such as:

The fees also vary greatly, depending on the cemetery operator and the effort involved. While some municipalities charge a flat processing fee, others bill based on the value or size of the gravestone.

The BIV Gravestone Guidelines, which are recognized nationwide as a standard in the stonemasonry trade, are often the determining factor in this regard.
If a gravestone is manufactured and installed according to these guidelines, additional structural verification is often not required. Nevertheless, some authorities require formal confirmation of stability—especially for larger or custom-made gravestones.
